Supreme Court Overturns Ban On Crush Videos

In 1999, Congress displayed a rare bout of bipartisanship when it unanimously passed a law prohibiting the production and distribution of videos which were  “made for a niche market of individuals who derive sexual satisfaction from watching animals being crushed and slowly killed”.  Much to the dismay of PETA and the National Association For The Advancement Of Hamsters, the U.S. Supreme Court just struck this law down as unconstitutionally vague.  The Court asserted in its decision that the law was “overly broad”, and Congress needs to reword the law to be more limited in scope.  This makes perfect sense.  In the midst of pressing domestic and international crises, Congress surely has the time to debate the verbiage of a law which precludes you from jerking off to stomped on gerbils.

According to a description courtesy of the Washington Post, these videos depict kittens and puppies being “slowly crushed by a woman wearing stiletto heels”.  The depravity of this fetish is clear, however, it does raise a valid question pertaining to where the line should be drawn when it comes to fetish flicks.  Surely, many of you reading this have fetishes which your average vanilla citizen would also deem depraved.  Who’s definition of depravity applies?

The bright line should be driven by the legality of the underlying act being filmed.  Crushing cute cats is, in itself, a criminal act — in the same vein as snuff films, child pornography and copies of old George W. Bush State Of The Union Addresses.  If the substance of what you are watching is illegal (not counting the laws of Mississippi and Alabama), then your procurement of the film represents the demand side of the equation spurring others to produce more such material.  Conversely, if what you are watching is legal, then you can jerk away with a clear conscience.  Ideally, the new rewritten law will provide for perpetrators to get a free trip to the elephant enclosure of the local zoo.  I hear they like crushing games too.
